What are the responsibilities and job description for the Assistant City Attorney - Public Safety position at City of Winston-Salem?
This position performs legal work assisting the City Attorney and will involve preparing ordinances, resolutions and opinions; prepares legal memoranda; reviews documents; represents the City in civil cases, appeals and administrative matters; performs related work as required. The incumbent works within a general outline of work to be performed and develops work methods and sequences under general supervision. Performs difficult professional work providing a wide range of legal advice to assigned departments, boards and commissions, including drafting and reviewing legal documents, and related work as apparent or assigned. Work is performed under the general direction of the City Attorney.
- Provides legal policy advice and counsel under the supervision of the City Attorney to the Winston-Salem Police Department, Winston-Salem Fire Department and Winston-Salem/Forsyth County Emergency Management;
- Manages an administrative caseload;
- Develops strong working relationships with department personnel and internal service departments in accordance with the City Attorney’s policies, standards, and practices;
- Responds to inquiries on police, fire and emergency management related matters that require the expertise of a legal advisor;
- Conducts research and analysis on a variety of issues under the supervision of the City Attorney and at the direction of the Police Chief and other Police Command staff, Fire Chief and other Fire Command staff and Winston-Salem/Forsyth County Emergency Management Director and staff and provides recommendations;
- Composes and/or edits reports, proposed legislation, letters and other materials; assists as requested in conducting legal research and developing strategies in response to claims and lawsuits involving the Police Department, Fire Department and Winston-Salem/Forsyth County Emergency Management;
- Consults on public disclosure-related issues;
- Meets with the City Attorney to review and discuss legal advice and related strategies;
- Prepares ordinances, resolutions and opinions, legal memoranda, administrative matters, and performs related work as required under the supervision of the City Attorney;
- Prepares cases and represents or assists in representing the City in problems of a legal nature;
- Prepares written legal opinions and gives legal advice as required;
- Reviews and prepares departmental contracts;
- Responds to open records requests;
- Attends City Council and Committee meetings to provide legal advice;
- May be required to work additional hours, as needed, in order to accomplish assigned work;
- Attends training, seminars, workshops, etc., as required to maintain job knowledge and skills;
- Drafts nuisance abatement letters, complaints and other legal documents and handles all aspects of nuisance abatement litigation;
- Publishes training material on new case law, legislation, and review established case law affecting police operations.
- Coordinate with the North Carolina Justice Academy Director and staff for training courses and providing specialized advanced legal training to state law enforcement officers.
- Teach Police Academy and in-house training programs supervising officers who are assigned for training.
- Provide written or oral legal opinions for officers and command staff on issues of criminal law, criminal procedures, and civil liability, and
- Performs other related duties as assigned.
Juris Doctor Degree and considerable experience with municipal law, litigation, real estate transactions, client representation, or equivalent combination of education and experience.
- Juris doctorate degree.
- Three (3) years of relevant prior experience in municipal law or equivalent combination of education and experience.
- Valid US Driver’s License.
- Licensed to practice law in North Carolina and a member in good standing with the North Carolina Bar.
