What are the responsibilities and job description for the Assistant Prosecuting Attorney position at Greene County, MO?
Purpose of Position
The purpose of this position is to prosecute misdemeanor and felony criminal cases by representing the citizens of Greene County, State of Missouri in criminal court, under the direction of the Greene County Prosecutor and supervision of the First Assistant Prosecuting Attorney for their assigned unit.
Essential Duties and Responsibilities
The following duties are normal for this position. These are not to be construed as exclusive or all-inclusive. Other duties may be required and assigned.
Represent the citizens of Greene County in Associate and Circuit Courts. This representation will include handling misdemeanor and/or felony cases for jury trials, bench trials, preliminary hearings, arraignments, change of plea hearings, motions, probation violation hearings, reappearances, and other criminal legal proceedings.
Review felony, misdemeanor, and traffic cases submitted to the Prosecutor’s Office for filing. Make a determination as to whether to file a criminal charge, decline a criminal charge, or request further investigation. It is also the responsibility of the reviewing prosecutor to complete the necessary paperwork regarding their decision.
Accurately document all case activity with appropriate docket entries in the case management system.
Return telephone calls, e-mails, and correspondence in a timely manner (in most cases within one business day)
Negotiate cases with defense attorneys for an appropriate disposition.
Prepare and draft pleadings, motions, and responses to be filed with the court.
Research legal issues and case law as it relates to issues and cases they are working on.
Contact victims and witnesses as necessary in the charging process to keep them informed of a case, and when necessary meet with them, prepare them for testifying, and answer their questions.
Remain on call 24 hours-a-day on a rotating basis to file criminal charges or respond to request by law enforcement after normal business hours. This will require work on weekends and holidays.
Take and defend depositions.
Assist and counsel law enforcement as it pertains to legal issues regarding an investigation and the facts needed to pursue a conviction.
Maintain a good standing with the Missouri Bar Association which includes completing the yearly required continuing legal education courses.
Maintain the highest level of integrity in all relationships which includes but is not limited to the police, victims, witnesses, judges, clerks, and defense counsel
Remain generally available during the business day to respond to request by the court to appear for unscheduled matters such as walk-in defendants.
Arrive at work punctually and without unexcused absences. As an exempt employee, an assistant prosecutor is not required to maintain a time sheet or billable hours. However, it is expected that the assistant prosecutor will be prepared for court. Often times this will require work after business hours and on weekends.
Be a team player and assist other prosecutors to achieve the primary mission of the Greene County Prosecutor’s Office which is to ensure a safe and secure community with justice for all.
Follow the directives and policies of the Greene County Prosecutor.
Additional Tasks and Responsibilities
While the following tasks are necessary for the work of the unit, they are not an essential part of the purpose of this position and may also be performed by other unit members.
Acts as a contact with news media representatives at the direction of the Prosecutor.
Review and assist law enforcement with search warrants.
Assist law enforcement with investigative subpoenas.
Perform community relations functions.
Work on special projects or case assignments as directed by the Greene County Prosecutor, Chief Assistant, and/or supervising First Assistant.
Assist in training of assistant prosecutors or staff.
Represent Greene County in an appellate court.
Minimum Training and Experience Required to Perform Essential Job Functions
Juris Doctor degree, licensed to practice law in Missouri; and a member of the Missouri Bar Association.

Negotiate and engage in formal plea agreements within the context of legal guidelines and office policy.
Communicate orally and in writing with attorneys, victims, witnesses, law enforcement, judges, court support staff, news media, and County Commissioners.

Work as a team with co-workers and work together to achieve justice for all citizens of Greene County.
Work tactfully, respectfully, and professionally, with defense attorneys, judges, and/or court staff and remain focused in seeking justice for all citizens of Greene County.
Mathematical Ability
Perform basic math.
Judgment and Situational Reasoning Ability
Exercise the judgment, prioritization, decisiveness, and creativity required in situations involving the planning, preparation, and execution of an entire case load and court docket.
Use logic, common sense, and legal reasoning in analyzing cases, determining trial strategy, evaluating the admissibility of evidence, and evaluating ramifications for various options in any given situation.
Know the ethical obligations of a prosecutor and strive to maintain unquestioned integrity.
Physical Requirements
Operate a variety of office equipment including lap top computer, trial presentation equipment, telephone, scanner, audio recorder, fax machine, and photocopier.
Coordinate eyes, hands, feet, and limbs in performing slightly-skilled movements such as computer keyboard use.
Ability to exert light physical effort in sedentary to light work, typically involving picking up, lifting, carrying, pushing, and pulling up to 50 pounds.
Must be able to function in a courtroom environment during the duty day which may exceed normal business hours based upon the needs of the court.
Environmental Adaptability
Work under generally safe and comfortable conditions where exposure to environment factors such as potential violence, irate individuals, and intimidation may cause discomfort and poses little risk of injury.
Condition of Employment
Employee will be required to demonstrate continued knowledge of this position’s current regulations and requirements. Sustained satisfactory performance is required. Employee must meet the requirements of the full job description as stated throughout the duration of employment with Greene County.
