Detailed Description

DUTIES & RESPONSIBILITIES:

To perform this job successfully, an individual must be able to perform each essential duty satisfactorily.

  • Monitors, reviews and advises on internal equal employment opportunities and compliance issues such as allegations of employment discrimination based on protected classes as defined in Title VI, Title VII, ADA, and other laws, Board Policies or Administrative Procedures that prevent discriminatory practices in hiring or employment;

  • Reviews complaints of employment discrimination to determine if the district has jurisdiction. When jurisdiction is not obvious due to insufficient information, obtains the necessary information from charging parties and/or through document requests. Resolves questions of timeliness, basis and standing under the law governing discrimination complaints. Obtains statements and affidavits from charging parties and/or witnesses and collates any documentary evidence;

  • Conducts investigation of equal employment opportunity and Title IX complaints, determines investigative methods to be used, interviews complainants, respondents, witnesses and other individuals, conducts site visits, reviews records and prepares fact finding reports and recommendations;

  • Mediates and utilizes alternative resolution and problem solving processes to resolve internal organizational complaints, as appropriate; uses creative and critical thinking in problem solving EEO issues and/or concerns; facilitates communication among employees and management by providing guidance and consultation regarding problem solving, dispute resolution, regulatory compliance, litigation avoidance and strives to resolve internal conflict informally through appropriate conflict management and mediation techniques;

  • Identifies training needs and develops and provides system-wide training for supervisors and employees on EEO, ADA and harassment related issues; provides guidance to staff;

  • Supports the design, development and review of standard operating procedures, administrative procedures and related policy documents to ensure consistent application of policies and program compliance; presents recommendations for policy and procedural changes based on identified needs;

  • Completes individually, or as a part of a team, a variety of related and unrelated special projects requiring specialized analytical, evaluative, and interpretive skill to achieve the internal school EEO program responsibilities for resolving and/or eliminating systemic discrimination;

  • Conducts monitoring, reviews and evaluations of internal ADA or EEO programs to ensure full compliance with all applicable laws. Develops and negotiates remedies and prepares written reports. Develops strategies for further investigation or data collection and analyses, reconciling difficult issues;

  • Advises charging party on non-technical and complex technical matters. Refers cases which cannot be resolved informally, which exceed the authority of the incumbent, or those involving highly sensitive or controversial technical matters to the designated staff, as appropriate;

  • Advises employees or applicants with unresolved EEO complaints, in accordance with established procedures, of various alternative courses of action available for resolution of issues (e.g., grievances, formal equal employment opportunity complaint, etc);

  • Researches, analyzes and assembles various required EEO and related reports;

  • Maintains records of pending actions to ensure timely follow up. Maintains control files. Reviews files to determine charges ready for investigation or conciliation, determines if charging parties wish to proceed, and either completes the investigation or conciliation, or prepares file for administrative closure;

  • Conducts surveys of employment trends with respect to equal employment opportunity in the geographical area served. Keeps abreast of developments in the field of equal employment opportunity law and other applicable disciplines. Establishes and maintains a rapport with individuals and groups within and outside of identified protected classes to obtain information on internal employment trends, EEO issues, and resource availability in order to obtain/improve agency goals related to EEO compliance; and

  • Performs other duties as assigned.

Job Requirements

QUALIFICATIONS:

The requirements listed below are representative of the knowledge, skill, and/or ability required.

  • Comprehensive knowledge and understanding of Federal and District EEO principles, laws, policies, regulations, executive orders, and court decisions, etc. based upon assignment, sufficient to develop EEO plans; implement complaint resolution, conduct internal investigations designed to respond to internal and external administrative complaints and provide guidance and assistance to management, employees, and applicants on a variety of difficult EEO issues and matters;

  • Familiarity with the district organizational structure and knowledge of pertinent district personnel management program administration, policies and practices which address specific EEO issues/concerns (i.e., Recruitment, selection, labor relations, classification and other personnel management functions);

  • Thorough understanding of the nature, review and monitoring of management actions and employment practices and conditions that constitute barriers to equal employment opportunity;

  • Demonstrated skill in the review and monitoring of management actions, employment practices and allegations of employment discrimination against protected classes as defined in Title IV, Title VII, ADA, and other laws or regulations designed to prevent discriminatory practices in hiring or employment;

  • Thorough knowledge of and skill in the application of analytical and evaluative methods and techniques such as research, fact-finding, analyses is necessary to resolve difficult problems; and to eliminate barriers to equal employment opportunities;

  • Demonstrated ability to analyze data and provide alternative solutions to problems;

  • Excellent oral and written communication skills to make presentations, conduct training seminars, negotiate settlements, write proposed decisions in complaint cases, and to complete other EEO assignments;

  • Extensive knowledge of principles and practices of equal employment, ADA and Title IX investigations, including interviewing methods and techniques;

  • Excellent interpersonal skills; and

  • Ability to work effectively with individuals and groups.

EDUCATION AND/OR EXPERIENCE REQUIREMENTS:

A Master's degree from an accredited college or university in employment law, human resources management or a closely related field required; Doctorate of Jurisprudence from an accredited law school preferred. A minimum of five (5) years of experience investigating local, state and federal discrimination complaints including Title VII, Title IX, ADA or a combination thereof required. In lieu of a Master's degree, a Bachelor's degree with a minimum of 7 years of related experience may be considered.

No direct supervisory responsibilities.

While performing the duties of this job, the employee may occasionally push or lift up to 25 lbs.
