Position Overview

Attorney needed! Under general direction this position performs a variety of technical and legal duties; receives complaints concerning the regulations of a variety of professions under the jurisdiction of the Division of Real Estate relating to both cases of alleged irregular practice by a licensee and cases of illegal practice by an unlicensed person. Conducts hearings and participates in informal conferences. Assembles the evidence, prepares and presents the written complaint and all pleadings; prosecutes the accused in hearings before an Administrative Law Judge, and, if applicable, the respective Board member. Presents the Board's written report of Findings and Recommendations to the Director. Presents the case to the State's Attorney or Attorney General’s Office or other enforcement authority to institute criminal proceedings. Travels to various sites for conferences and meetings

Essential Functions

  • Conducts hearings and participates in informal conferences on complaints arising under the law within area of responsibility.

  • Assembles the evidence, prepares and presents the written complaint and all pleadings.

  • After decision by the Boards, presents the Board's written report of Findings and Recommendations to the Director.

  • Recommends referral of unlicensed practice cases to be prosecuted by sister enforcement agencies to the appropriate county, and presents the case to the State's Attorney or Attorney General’s Office or other enforcement authority to institute criminal proceedings.

  • Prepares the Department Record and Answer in mandamus actions brought against the Department under the acts within area of responsibility.

  • Consults with attorneys, members of the public, law enforcement officials, and other interested parties regarding the application of the licensing laws within area of responsibility and the Rules and Regulations promulgated thereunder.

  • Performs other duties as required or assigned which are reasonably within the scope of the duties enumerated above.

Minimum Qualifications

  • Requires graduation from a recognized law school.
  • Requires possession of a valid license to practice law in Illinois.

Preferred Qualifications

  • Prefers at least two years of trial or equivalent experience or training in judicial and quasi-judicial procedure and of the rules of evidence, hearings, and trial procedure.
  • Prefers at least two years of experience analyzing complex legal issues and writing complex legal memorandums
  • Prefers at least two years of experience providing legal counsel substantially related to real estate matters.
