What are the responsibilities and job description for the Senior Risk Management Counsel position at U.S. Xpress, Inc.?
Primary Position Purpose:
Provides legal advice and counsel regarding litigation and claims cases to Executive Leadership and Vice President of Risk Management for both USX and TTMS.
Position Functions:
- Provide legal support to company management including attending meetings, assessing legal, regulatory, and business risks in proposed courses of action and/or policies, providing advice and guidance as to best course of action, and assisting in the documentation of elected course of action.
- Keep executive team apprised of status of claims and litigation, including weekly, monthly, or quarterly reporting as requested.
- Oversee and lead engagements in the Litigation and Claims department from planning through reporting. Produce quality deliverables in accordance with departmental and company standards.
- Manage the development of corporate policies, such as data retention, compliance matters, changes in applicable laws, contract management, and claims handling.
- Retain and manage outside counsel, preserving documents and evidence, ensuring litigation holds are in place, reviewing and/or drafting in conjunction with outside counsel various pleadings and/or discovery responses, assisting in the identification and preparation of witnesses, and maintaining litigation files.
- Prepare USX and TTMS employees as corporate witnesses and drivers named in active litigation.
- Maintain awareness and understanding of current and proposed laws and regulations pertinent to the trucking industry and other specific areas of responsibility.
- Review, investigate, and respond to administrative or regulatory complaints and charges.
- Partner in the preparation of financial and loss run reporting.
- Able to travel to depositions, mediations, and trials up to 25%.
- May include other duties as assigned by management.
- Collaborate in-person with all levels of the organization to harness collective intelligence of the workforce.
- Attend all in-person meetings and trainings on recent developments, goals, and objectives. Participate in such discussions by offering input and advice.
- Regularly engage remotely and in-person with customers and potential customers to establish rapport, open communication, and expectations.
What We’re Looking For:
Education
- Juris Doctorate from an accredited law school required
Experience
- 10 years of progressive experience in claims and litigation required
- 5 years of experience in transportation industry required
Skills & Abilities
- Superior written and verbal communication and interpersonal skills
- Strong problem-solving skills
- Ability to work independently, efficiently, proactively, and effectively on multiple projects under tight deadlines
- Proficient in Microsoft Office suite
- Adept at assessing organizational dynamics and managing change
- Works quickly and efficiently. Able to test solutions, learn, and iterate quickly
- Proactive and pragmatic problem solver
- Communicates effectively across multiple mediums
Licenses & Certifications
- Current law license in good standing
Supervisory Responsibility
- Will supervise 2-3 professional level direct reports
